Kevin Costner wanted ironclad prenup after first marriage left him homeless

Kevin Costner has vowed never to let a marriage leave him homeless again.

In court records obtained by The Post, Costner admits that “securing his right to access his separate property residences in the event of a divorce was an important priority” for him.

“Kevin was married once before and, upon separation, he found himself without a home base and unable to live in his own home,” the filing reveals. “He never wanted that to happen again.”

This all comes as part of the latest divorce filing, in which Costner says he hoped to return to his home at the beginning of June, when his out-of-town work commitments ended — but his estranged wife is refusing to leave.

Costner purchased an oceanfront estate in Carpinteria, California back in 1988, along with the adjacent property — 16 years before he married his now-estranged wife, Christine Baumgartner.

Prior, he was married to Cindy Costner from 1978 until their divorce in 1994, which reportedly resulted in an $80 million settlement.

In the filing, Costner claims Baumgartner has failed to uphold her end of the agreement when they signed a prenup back in 2004.

“When the parties began discussing marriage in 2003, Kevin made it clear to Christine that he would

not marry again without clarity that his separate property residences would remain his to live in no

matter what happened in their marriage,” the documents say, adding, “Christine acknowledged to Kevin at the time that she understood the importance of this to him and she agreed to this provision.”

The two signed a pre-marital agreement in September 2004.

Costner has been renovating and updating this longtime oceanfront estate in Carpinteria. Most recently, in March 2022, he took out a near $3 million loan for updates on the near 5,000-square-foot estate.

The filing states that Costner has complied with the financial obligations under the prenup agreement, which includes paying Baumgartner $200,000 in the first two years of marriage, and upon the filing of the divorce petition, paying her $1 million as required.

Additionally, Costner has agreed to pay Baumgartner an additional $200,000 for a down payment on a new residence “if they did not jointly acquire a residence during marriage, which they did not do,” the documents state.

Costner accuses his wife of attempting to make “unreasonable financial demands as a condition to moving out.”

“Negotiations have thus far proved unsuccessful,” the document says. Costner’s lawyers also say that the “Yellowstone” actor is willing to pay his wife a monthly mortgage, property tax and insurance

payments on her new residence for a period of one year.

Meanwhile, both parties are requesting equal custody of their three children. Costner continues to pay 100% of the children’s expenses.

The Post has reached out to Baumgartner’s reps for comment.
