Joe Manganiello, 46, OFFICIALLY files for divorce from Sofia Vergara, 51, citing 'irreconcilable differences' amid claims they differed over having children... and $100M prenup won't be contested
Joe Manganiello has officially filed for divorce from Modern Family star Sofia Vergara.
The former couple shocked fans earlier this week when they announced that they would be separating after seven years of marriage.
In court docs obtained by TMZ, the Magic Mike actor cited 'irreconcilable differences' — with the outlet claiming that Joe wanted children with the actress, who is already a mother to 31-year-old son Manolo Gonzalez Vergara.
Sofia and Joe have a $100million prenup in place which protects the assets they've both accumulated during their married years.
And a source told the outlet that Sofia has no plans to contest the agreement — which she had him sign prior to their May 2015 wedding.
She reportedly boasts a net worth of $180million compared to Joe's $40million.
DailyMail.com reached out to representatives for Joe, who will not be commenting at this time, while reps for Sofia have yet to respond.

He is being represented by celebrity divorce attorney Laura Wasser, who has worked with the likes of Kim Kardashian and Johnny Depp.
As for attorneys' fees, the pair are said to be covering their own costs.
There was no mention in TMZ's report of who will profit from the pair's Beverly Hills home, which was re-listed in June for $18million — less than two months before announcing their split.
They originally listed it last summer for $19.6 million after a remodel but took it off market.
It was previously alleged by TMZ that Sofia had forked over the original $10.4million needed to snap up the seven-bedroom, 11-bathroom home in 2015 ahead of their nuptials.
The sprawling 11,000 square foot mansion comes with a 10-seat movie theater, full size gym with sauna and 3,000 bottle wine cellar. It is located in the highly exclusive and desirable neighborhood of Beverly Park.
The Italian-style villa is co-listed with Barry Peele of Sotheby's International Realty and Santiago Arana of The Agency.
Sofia and Joe reportedly purchased a second residence nearby that is still under-construction but details about the deal are unknown and whether it was a joint investment are unknown.
Sofia's disinterest in welcoming another child may come as no surprise as she famously duked it out in court with her ex-fiance Nick Loeb over their frozen embryos.
The businessman, 41, sued the Modern Family actress after they split in 2014 in a bid to stop her from destroying the embryos, and over the course of their seven-year legal battle, the two also became intertwined in a very-public media war, hurling a slew of insults and making a series of personal jabs at one another in numerous interviews.
It all began when they decided to use invitro fertilization to create two embryos in 2013, three years into their romance, which they then decided to freeze.
At the time, Sofia explained that she wasn't ready to start a family with her beau just yet, but that when the time came, they would have to use a surrogate since she had undergone radiation years prior.
But when their relationship came crashing down a year after that - Nick later claimed that they split because she was more interested in 'fame' than starting a family - the fate of those embryos sparked a feud that would ensue for years to come.
'Pro-life' Nick still wanted to use them to become a father, while Sofia argued that he had previously signed a contract stating he could not bring them to term without both parties' consent and that a child should not be born without its parents being in a 'loving relationship.'
The Hollywood starlet also accused her ex of using the court case as a desperate attempt to launch his own career and gain fame, while he alleged she had been 'physically and emotionally abusive' to him throughout their three-year romance.
Nick certainly fought hard, filing lawsuit after lawsuit even after he was forced to drop the first when it was brought to light that two women he had previously impregnated had gotten abortions - something that completely contradicted his prior statements that the embryos had a right to live because 'life begins at conception.'
Sofia's ex even started renting out a residence in Louisiana, a state that offers special legal protections for frozen embryos, to improve his chances of winning.
And while the court did ultimately rule in the Columbian-American actress' favor, Nick still hasn't backed down, and he's now in the midst of suing the fertility clinic that they used.
Though she did not welcome children with Joe during their seven-year marriage, Sofia and her now-estranged husband do share a 10-year-old Chihuahua named Bubbles.
According to California law, a judge can weigh in on who should get pets in a divorce.
In January 2019, a new California law changed the way pet custody is handled in divorce cases. This new law gives judges the power to consider the care and the best interest of the pet when making decisions in separation or divorce matters.
News of Joe's divorce filing Wednesday comes shortly after DailyMail.com exclusively revealed that he is 'ready to move on and fall in love with someone' else.
A source close to the former couple has claimed that Joe wants to put his relationship with Sofia behind him so he can 'have fun again.'
The insider explained that while Joe 'thought Sofia was the one,' he is 'not looking back,' and wants 'as little drama' as possible.
'Joe wants the divorce to go as clean as possible. He would love as little drama [as possible] to come from it,' they dished.

'Joe is ready to date, ready to move on, ready to have fun again and fall in love with someone.'
The source added that Joe 'never wanted to be single,' but is looking forward to 'making someone else happy,' which will 'in turn make him happy.'
'He never wanted to be single, he thought Sofia was the one, but he knows that since it didn't work with Sofia, he is getting to a better place within himself to move on to make someone else happy, which in turn will make him happy,' they continued.
'He is not looking back and there isn't a situation where this will be like Ben and JLO, they aren't going to get back together.'
Ben Affleck and Jennifer Lopez famously became Hollywood's 'it' couple in the early 2000s, but eventually split and both moved on with other people. However, they ended up reconciling two decades later, and are now happily married.
The source explained that while Joe is embracing the next chapter in his life, he will likely keep any potential new love interests hidden from the public to avoid people 'judging' him.
'Joe will never dodge an opportunity if the opportunity is right. He does that with his work, he does that with his relationships,' they continued.
'But when it happens, don't expect him to shove it down our throats [because] he would like to move into a new relationship with little to no reaction.
'He doesn't want to be tied into a situation where people are judging his relationships in the future. He just wants to live a happy life.'
DailyMail.com has contacted Joe's spokesperson for comment.
Joe and Sofia announced that they were going their separate ways on Monday, saying in a statement that they had 'made the difficult decision to divorce' but still 'love and care for one another.'
They first started dating in August 2014 and tied the knot just over a year later in November 2015, during a stunning Florida wedding attended by 400 friends and family members.
When their split was first revealed, a source told DailyMail.com that the two had drifted apart due to their 'different attitudes.'
They dished: 'Joe is a big kid, he loves playing Dungeons & Dragons, he loves wrestling, he is all about video games, superhero movies, comic books, going to concerts, huge NFL fan. He chases fun.

'He always loves being out and about and just having a good time. And then when it is time to be serious and when it is time to get to work, he turns on that part of himself, but he is always ready to live life to the fullest and go out and just be fun and have fun.
'This was immediately an attraction for Sofia who is completely the opposite, sure she loves having a good time and going out, but she is more concerned with the finer things in life, the trips, lavish dinners, being a celebrity, and everything that comes with all of that.
'She has been told her entire life she is super-hot and beautiful. It really has got to her head.
'She also has a temper and gets upset over stupid things very easily whereas Joe tries to let things bounce off of him and go with the flow.
'That was not really seen while they were falling in love, but then the true versions of themselves started showing and they just got annoyed with each other, choosing work over hanging out.
'Then bit by bit, they stopped wanting to be together and stopped hanging out because something so little would often trigger an attitude that would bug them, just their attitudes on everything were completely different and something like that is extremely draining for a relationship and they got to the point where it would be a good day and one thing would be said or done and they would just get upset with each other.
'It added up to where now it is easier and more relaxing not being together. When people say they will be friendly, they will, but the romance part of things is over. They grew a part from something that could have been really good.'
Another source close to the pair suggested that Joe's sobriety 'impacted' their marriage, explaining that the actor was 'warned' about getting into a serious relationship with someone who was not actively sober.

Joe stopped drinking in 2002 - more than two decades ago - after he said he became 'broken beyond the point of being fixed.'
'Of course the fact that Sofia is not sober had an impact on their marriage,' the insider said.
'He was warned about this when he started dating her and again before marrying her.
'He did not think that he was going to change her but he also didn’t think about the implications this could have on their marriage.'
However, a different insider insisted that Sofia - who often shares images of herself drinking alcohol on her social media accounts - 'could not have been more supportive' of her estranged husband's sobriety.
